Terms of Service

Definitions:
UKGAME refers to BB Dev Limited, the company which owns UKGAME.
Our Company also refers to BB Dev Limited.
The Client refers to "you", the customer of BB Dev Limited.

These terms and being bound to them.
You must have read our terms of service before making any payment to Our Company, once you have made payment you are assumed to have accepted these terms of service and will be bound to them.

1. Your right to Service.
UKGAME reserve the right to suspend or cancel with immediate effect, access to any service, when UKGAME decide the account is being used inappropriately, or should we be unable to continue service. You will in this case be entitled to a refund of your remaining unused time less an administration fee of £4.00+vat, should this mean the refund is a negative amount clearly you will not be expected to make any further payment.

2. Acceptable use of Service.
Accounts are for the use of the Primary owner only (the person who signed up), Account holders are not permitted to borrow, lend, or sell their servers, webspace or resources to any other person, company or other third party.

UKGAME hold the right to refuse service / and or access to any party should we decide the application is inappropriate, such as an applicant wishing to host "warez", "illegal files", "pornography" or "obcene publications".

Prohibited Material
The following material is strictly prohibited.

illegal Material - This includes copyrighted works, commercial audio, video, or music files, "mp3's", ".exe files" and any material in violation of any Federal, State or Local regulation. And especially any adware, spyware or virus software.

Adult Material- this includes ALL Pornography, erotic images and media, and any other obscene material. What is and what isn't "Adult Material" is entirely at the discretion of UKGAME.

Warez- Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. This also includes links to any sites that mention or contain the above.

Malicious and Unfriendly Activity
UKGAME services can not be used for any activity that affects, corrupts, or is harmful to other perople, companies or organizations.

Backups and Data
UKGAME does not keep backups of customer data, and we strongly suggest you keep regular backups of your data to avoid any loss. We are not responsible for any loss of your data, and no compensation will be issued for this.

Payment Policy
We accept, Paypal, Cheques or Bank transfers (under strict rules). We may accept other methods which will be listed on our billing system, we will not accept Postal Orders at present or any method not listed on our ordering forms / systems.
Service will start from the date the server is ordered, and will end if canceled taking into account any delay in ordering to server setup.
This is most important as servers will not be setup until cheques clear or bank transfers arrive should this payment option be used.

Recurring payments must clear before the renewal date, failure to do so will result in your server being suspended and we reserve the right to delete unpaid server data instantly should a service be unpaid by the renewal date. As a result we strongly suggest using Paypal Subscriptions as your payment option.



GAME SERVER TERMS OF SERVICE

USER CONDUCT
Client must act with their best intentions at all times, bullying, racism, swearing (especially before 9pm), libelous, defamatory, obscene and many other types of behaviour will not be tollerated and may result in the termination of your account with UKGAME.

Abusive, sexual, insulting, threatening or upsetting behaviour to any UKGAME (BB Dev Limited) staff will be treated seriously and will be reported should it be very extreme, but will in any case result in termination of your services. (You will in this case be entitled to a refund of your remaining unused time less an administration fee of £4.00+vat, should this mean the refund is a negative amount clearly you will not be expected to make any further payment.)

FAIR USAGE POLICY
Customers may install and use third party modifications within reason. No assurance is made as to if these will be stable and they may cause your services to crash. UKGAME will in rare cases ban you from using mods or bot configurations that use excessive resources on our servers that may effect other clients. Under no circumstances may game servers be used as file distribution systems apart from map/audio/model/texture downloads for your clients connecting to your servers.


CUSTOMER INFORMATION
The client must at all times keep their contact information up to date.

CANCELLATIONS AND REFUNDS
UKGAME reserve the right to cancel any service at any time without any notice, we do however hope to offer at least 3 working days notice of any cancelation to your services where possible.
Customers will be refunded on a pro-rata basis for the remaining time that they will not have used on their services, a £4.00 + vat administration fee is only charged on refunds should the services be cancelled due to breach of terms, should UKGAME cancel your services for other reasons then this fee will not be applicable.

Clients may cancel their services at ANY time, however any prepaid money is non refundable and the service will remain operational until the renewal date. You are required to give 5 working days notice before renewal date to cancel your service. You must open a support ticket to do this via the support link on the website.

QUALITY OF SERVICES
UKGAME will always do its best to ensure our services are the best they can be and hopefully the best that you can buy. UKGAME will not be responsible for any damages due to downtime, data loss, or failure of service except due to the following;
a) Gross negligence, This is defined as loss of your data due to lack of care, loss of your personal information to another organisation, or downtime in excess of 24 hours in any month, this will be rewarded by a 100% refund of your monthly server cost either as a service credit to your account or in the form of a cheque that can be posted to you for a £1.00 + vat administration fee.
b) Your service quality is effected by another client abusing our fair usage policy terms. If this is not resolved within 3 working days you will be entitled to a 100% refund of your monthly server cost either as a service credit to your account or in the form of a cheque that can be posted to you for a £1.00 + vat administration fee.

In any case you MUST inform us of any issues you have via support ticket or no refunds will be applicable.

Server Branding
UKGAME is currently offering FREE debranding of servers, but we do request that you keep ukgame.com in the title of your server somewhere if you wish, and we may from time to time offer prizes to those who do.

SETUP TIME SCALES
Most of our services will always be setup for full automation, especially if paid for by an instant method (such as paypal). And setup should be complete within 15 minutes. If you have not been emailed details by this time open a support ticket to bring our attention to it, as sometimes things go wrong.
You MUST open a support ticket if you do not recieve an email with details of your services within 15 minutes of cleared payment.

UKGAME will not be responsible for any damages your business may suffer. Or that you personally may suffer. We make no assurances that our services may not cost you in other ways and should be used with extreme caution, We do not suggest playing for long periods of time (over 45 minutes at a time) on your game servers.
Loss of Data, slow delivery of service, wrong delivery, or any service interuption will not result in compensation.
